India Market Online Store Regulations
§ 1. General provisions
- These Regulations define the rules of using the India Market online store, available at: https://indiamkt.myshopify.com/, in particular:a) rules of placing Orders,b) rules of concluding Sales Agreements,c) rules of providing services electronically,d) rules of making payments,e) rules of delivery,f) rules of withdrawal from the Agreement,g) rules of submitting and considering complaints.

e-mail: biuro@indiamarket.pl tel: 0123-456-789 - The Regulations are made available free of charge on the Store's website in a manner enabling their acquisition, reproduction and recording.
- The Customer is obliged to use the Store in a manner consistent with the law, good practices and the provisions of these Regulations.
- The Store sells in Poland and to the following countries: Germany, the Czech Republic, Slovakia, Lithuania, Latvia and Belarus, with the reservation that the availability of delivery to a given country may depend on the current offer of carriers and the technical capabilities of the Store.
§ 2. Definitions
The terms used in the Regulations mean:
- Store – India Market online store operated at https://indiamkt.myshopify.com/
- Seller – Chopina 6/LU2, Katowice, 40-095
- Customer – a natural person, legal person or organizational unit without legal personality, to which the provisions grant legal capacity, making purchases in the Store
- Consumer – a natural person who enters into a legal transaction with the Seller that is not directly related to his or her business or professional activity
- Entrepreneur with consumer rights – a natural person concluding a contract directly related to his/her business activity, when the content of this contract indicates that it is not of a professional nature for this person, resulting in particular from the subject of the business activity performed.
- Account – an electronic service, a set of resources in the Store’s IT system marked with an individual name and password, in which the Customer’s data and information about the Orders placed by him are collected.
- Order Form – an interactive form available in the Store enabling the placement of an Order.
- Order – a declaration of will of the Customer aimed directly at concluding a Goods Sales Agreement with the Seller.
- Goods – a movable item presented in the Store, which is the subject of the Sales Agreement.
- Sales Agreement – a contract for the sale of Goods concluded between the Customer and the Seller via the Store.
- Working days – days from Monday to Friday, excluding public holidays.
§ 3. Types and scope of services provided electronically
- Through the Store, the Seller provides the following services electronically:a) enabling browsing of the Store's assortment,b) maintaining a Customer Account,c) enabling placing Orders using the Order Form,d) enabling contact with the Seller via the contact form.
- Electronic services are provided free of charge.
- The agreement for the provision of services by electronic means: a) in the case of a service consisting in maintaining an Account – it is concluded upon registration of the Account by the Customer, b) in the case of a service consisting in enabling the placement of an Order – it is concluded upon commencement of use of the Order Form, c) in the case of a contact form – it is concluded upon commencement of use of this functionality.
- The Customer may terminate the use of services provided electronically at any time and without giving any reason, subject to the rights acquired before the termination of the contract.
§ 4. Technical requirements
- To use the Store, you must have: a) a device with Internet access, b) an up-to-date web browser, c) an active e-mail account, d) cookies and JavaScript enabled, to the extent necessary for the proper operation of the Store.
- The Customer is obliged not to provide illegal content.
§ 5. Customer Account
- Creating an Account is voluntary and free of charge.
- Purchases in the Store can also be made without registering an Account.
- Account registration requires providing the data indicated in the registration form and accepting the Regulations, if the Store provides for such an obligation.
- The customer is obliged to provide true and current data.
- The Customer is obliged to keep the access data to the Account confidential.
- The Customer may delete the Account at any time by contacting the Seller at the following e-mail address: biuro@indiamarket.pl
§ 6. Placing Orders and Concluding a Sales Agreement
- Information about the Goods published in the Store constitutes an invitation to conclude a contract, and not an offer within the meaning of the Civil Code.
- The Customer may place Orders 7 days a week, 24 hours a day, subject to technical breaks.
- To place an Order, the Customer: a) selects the Goods and adds them to the basket, b) goes to the order form, c) provides the required data, d) selects the delivery and payment method, e) confirms that he/she has read the Regulations, if the Store provides for such an obligation, f) approves the Order and confirms his/her willingness to conclude a contract.
- The Order is placed upon successful submission of the Order Form to the Seller.
- After placing the Order, the Customer receives an e-mail confirming its receipt.
- The Sales Agreement is concluded upon acceptance of the Order for execution by the Seller, of which the Customer is informed electronically.
- The Sales Agreement is concluded in Polish.
- The prices of the Goods given in the Store are expressed in Polish zloty and are gross prices, i.e. they include VAT, provided that the given Goods are subject to VAT.
§ 7. Payments
- The Customer may choose the following payment methods: a) payment via Przelewy24, b) BLIK payment, c) standard bank transfer, d) cash on delivery, if available for a given delivery method, e) Apple Pay / Google Pay, if available as part of the provided payment methods.
- If you choose a standard bank transfer, the Customer must make payment within 3 business days of concluding the Sales Agreement. If this deadline expires without effect, the Seller may cancel the Order.
- In the case of payments made via an online payment operator, the entity providing payment services is PayPro SA operating under the Przelewy24 brand , in accordance with the rules set out by that operator.
- If card payments, Apple Pay or Google Pay are made available, such payments are processed in accordance with the rules of the payment operator.
- The Seller issues VAT invoices in accordance with applicable law.
§ 8. Delivery
- Delivery of Goods is carried out in the territory indicated in § 1 section 5 of the Regulations.
- Available delivery methods include: a) InPost, b) DHL, c) DPD, d) personal collection.
- The cost of delivery within Poland is PLN 9.99, unless otherwise expressly stated in a given Order.
- Free delivery within Poland is available from the amount of PLN 199.00, unless different conditions are specified in a given promotional campaign or offer.
- In the case of foreign Orders, the delivery cost is indicated to the Customer when placing the Order, before its final confirmation.
- Personal collection is free of charge and possible at: Aleja Krakowska 48, 05-090 Janki.
- The standard order processing time is 1 to 2 business days, unless a different time is specified for a given Product.
- The delivery time consists of the time it takes to prepare the Order for shipment and the time of delivery by the carrier.
§ 9. Right of withdrawal
- The Consumer and the Entrepreneur with consumer rights have the right to withdraw from the Sales Agreement concluded at a distance without giving any reason, within 14 days from the date of taking possession of the Goods by the Customer or a third party indicated by him other than the carrier.
- In order to exercise the right to withdraw from the Agreement, the Customer should submit an unequivocal declaration to the Seller, in particular by e-mail to the following address: biuro@indiamarket.pl
- The Customer may use the model withdrawal form provided by the Seller, but this is not obligatory.
- To meet the withdrawal deadline, it is sufficient to send the declaration before its expiry.
- In the event of withdrawal from the Agreement, it shall be deemed not to have been concluded.
§ 10. Consequences of withdrawal from the contract
- In the event of effective withdrawal from the Agreement, the Seller shall refund to the Customer all payments received from him, including the costs of delivery of the Goods to the Customer, with the exception of additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery method offered by the Seller.
- The payment will be refunded immediately, no later than within 14 days from the date of receipt of the declaration of withdrawal from the Agreement, subject to the possibility of the Seller withholding the refund until the Goods are received back or the Customer provides proof of sending them back, whichever occurs first.
- Refunds will be made using the same payment method used by the Customer, unless the Customer expressly agrees to a different payment method that does not involve any costs for the Customer.
- The cost of returning the Goods in the event of withdrawal from the Contract is covered by the Seller.
- In order to arrange a return at the Seller's expense, the Customer should contact the Seller by e-mail at: biuro@indiamarket.pl and follow the provided return instructions.
- The Seller does not accept the return of a voucher or a gift certificate instead of cash as a standard form of settlement, unless the Customer expressly consents to this.
- The Customer is liable for any reduction in the value of the Goods resulting from their use in a manner that goes beyond what is necessary to establish the nature, characteristics and functioning of the Goods.
§ 11. Exceptions to the right of withdrawal
- The right to withdraw from the Agreement does not apply in cases provided for by law, in particular in relation to Agreements:a) the subject of which are Goods that spoil quickly or have a short shelf life,b) the subject of which are fresh fruit and vegetables,c) in other cases specified in applicable law.
§ 12. Complaints regarding Goods
- The Seller is liable to the Consumer and the Entrepreneur under consumer rights for the compliance of the Goods with the Agreement in accordance with applicable law.
- Complaints can be submitted: a) electronically to the following address: biuro@indiamarket.pl, b) in writing to the following address: Chopina 6/LU2, Katowice, 40-095
- It is recommended to provide the following information in the complaint: a) the name and surname or business name of the Customer, b) contact details, c) the Order number, d) a description of the non-conformity of the Goods with the Agreement, e) the Customer’s request.
- The lack of data indicated in paragraph 3 does not prevent the consideration of the complaint if the complaint can be considered on the basis of the information provided.
- The Seller shall respond to the complaint within 14 days of its receipt, if such an obligation results from legal provisions.
§ 13. Complaints regarding electronic services
- Complaints regarding the operation of the Store or services provided electronically can be submitted to the following e-mail address: biuro@indiamarket.pl
- The complaint should include a description of the problem and the contact details of the reporting person, if this is necessary to provide a response.
- The Seller will consider the complaint within a reasonable time, no longer than 14 days, unless the nature of the case requires a longer time, of which the Customer will be informed.
§ 14. Promotions and discount codes
- The Seller may organize promotional campaigns, price reductions and provide discount codes.
- Unless the terms of a given promotional campaign state otherwise: a) promotions cannot be combined, b) a discount code can only be used under the terms indicated by the Seller, c) promotions are valid for a specified period or while stocks last.
- Detailed rules for individual promotions may be specified separately.
§ 15. Personal data
- Customers' personal data are processed by the Seller in accordance with applicable law and in accordance with the Privacy Policy available on the Store's website.
- Detailed information on the processing of personal data, the rights of data subjects and the security measures applied can be found in the Privacy Policy.
§ 16. Extrajudicial methods of resolving disputes
- The consumer has the option of using out-of-court complaint and redress procedures in accordance with applicable law.
- In particular, the Consumer may: a) contact the competent provincial inspector of the Trade Inspection, b) seek assistance from the municipal or district consumer ombudsman, c) use other available methods of out-of-court dispute resolution.
- Detailed information on out-of-court dispute resolution methods can be found on the websites of the relevant public authorities.
§ 17. Provisions regarding entrepreneurs
- The provisions of these Regulations concerning the Consumer also apply to the Entrepreneur with consumer rights, if this results from applicable legal provisions.
- In the case of Customers who are not Consumers or Entrepreneurs with consumer rights, the Seller's liability may be limited to the fullest extent permitted by law.
- Any disputes with the Seller will be resolved by a court with local and material jurisdiction in accordance with the provisions of law, subject to mandatory provisions.
§ 18. Final provisions
- The regulations are effective from March 10, 2026.
- The Seller reserves the right to change the Regulations for important reasons, in particular: a) changes in legal provisions, b) changes in payment or delivery methods, c) technical or organizational changes concerning the operation of the Store, d) extension or change of the functionality of the Store.
- The Regulations in force at the time of conclusion of the Agreement shall apply to Sales Agreements concluded before the entry into force of the new Regulations.
- In matters not regulated in these Regulations, the provisions of Polish law and relevant provisions of European Union law, in particular those relating to consumer protection, shall apply.
- The Regulations do not exclude or limit the rights of the Consumer and the Entrepreneur under the consumer rights arising from mandatory provisions of law.
COOKIES POLICY OF THE INDIA MARKET ONLINE STORE
1. General provisions
- This Cookie Policy sets out the rules for the use of cookies and similar technologies in the India Market online store, operated by Chopina 6/LU2, Katowice, 40-095.

- The Store uses cookies and similar technologies to ensure the proper operation of the website, maintain user sessions, remember settings, and conduct statistical analyses of Store traffic.
2. What are cookies?
- Cookies are small text files stored on the end user's device when using a website.
- Cookies enable the recognition of the user's device and appropriate adjustment of the website's operation, in particular maintaining the session, remembering preferences or analysing how the website is used.
- The Store may also use technologies similar to cookies, provided they are necessary for the proper operation of the website or used in accordance with the user's choice.
3. Types of cookies used
The following types of cookies may be used in the Store:
- necessary cookies – files necessary for the proper operation of the Store, including session management, shopping cart, ordering process, security and basic website functions;
- Functional cookies – files enabling the user to remember selected settings and improve the convenience of using the Store;
- analytical cookies – files that allow for the analysis of traffic in the Store, the manner of using the website and improving its operation; the Store uses the Google Analytics tool ;
- The store does not use advertising, remarketing or ad personalization cookies.
4. Entities using cookies
- Cookies may be placed by the Administrator.
- Cookies may also be placed by external service providers used in the Store, in particular: a) Shopify – as the store platform provider, b) Google Analytics – as an analytical tool.
5. Purposes of using cookies
Cookies may be used for the following purposes:
- ensuring the proper operation of the Store;
- maintaining the user session after logging in;
- remembering selected technical and functional settings;
- enabling the proper functioning of the shopping cart and ordering process;
- statistical analysis of traffic and use of the Store, in particular using Google Analytics;
- improving the performance, security and quality of the website.
6. Basis for using cookies
- Necessary cookies may be used to the extent necessary for the proper provision of electronic services and to ensure the operation of the Store.
- Optional cookies, including analytical cookies, may be used based on user consent expressed via the cookie banner or privacy settings available in the Store.
- Consent to optional cookies is voluntary and may be withdrawn or changed by the user in accordance with the mechanism provided in the Store.
7. Cookie management
- You can manage your cookie preferences using the cookie banner or privacy settings available in the Store.

- Data collected using cookies may be used for technical, statistical and organizational purposes, in accordance with the consent granted by the user or to the extent necessary for the operation of the Store.
10. Changes to the Cookie Policy
- The Administrator may change this Cookie Policy in the event of: a) changes in legal regulations, b) changes in the technologies used in the Store, c) implementation of new analytical or functional tools, d) changes in the operation of the cookie banner or privacy settings.
- The current version of the Cookies Policy is published on the Store's website.
11. Final provisions
- This Cookie Policy is effective from March 11, 2026.
- In matters not regulated by this Cookie Policy, the relevant provisions of Polish and EU law shall apply.
